This Notice of Privacy Practices (“Notice”) describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Harbor Healthcare LLC (“Harbor”) is required by law to maintain the privacy of your protected health information (PHI), provide you with this Notice, and follow the terms of the Notice currently in effect.

What is Protected Health Information (PHI)?

PHI is individually identifiable health information that relates to your past, present, or future physical or mental health condition, the provision of healthcare to you, or payment for healthcare. This includes information provided during intake questionnaires, telehealth consultations, prescription records, and related communications.

How We May Use and Disclose Your PHI

For Treatment

We may use and share your PHI with licensed healthcare providers who deliver care through our platform. This includes sharing your health history, symptoms, and medications with the physician conducting your consultation so they can diagnose, prescribe, and manage your treatment plan.

For Payment

We may use and share your PHI to process payments, verify insurance (if applicable), and handle billing and claims. This includes sharing necessary information with our payment processors and pharmacy partners.

For Healthcare Operations

We may use your PHI for quality improvement, training, compliance audits, customer service, and other internal operations necessary to run our business and ensure you receive quality care.

As Required by Law

We may disclose your PHI when required by federal, state, or local law, including court orders, subpoenas, or mandatory reporting requirements (such as reporting communicable diseases or suspected abuse).

Public Health and Safety

We may disclose your PHI for public health activities, including reporting adverse drug reactions to the FDA, preventing or controlling disease, or averting a serious threat to health or safety.

Business Associates

We may share your PHI with trusted third-party service providers (“Business Associates”) who perform services on our behalf, such as pharmacy fulfillment, data hosting, and analytics. All Business Associates are contractually required to protect your PHI in accordance with HIPAA.

Uses and Disclosures Requiring Your Authorization

We will obtain your written authorization before using or disclosing your PHI for purposes not described in this Notice, including:

  • Marketing communications (except for face-to-face communications and promotional gifts of nominal value)
  • Sale of your PHI
  • Most uses of psychotherapy notes (if applicable)

You may revoke your authorization at any time in writing, except to the extent we have already acted in reliance on your authorization.

Your Rights Regarding Your PHI

Right to Access

You have the right to inspect and obtain a copy of your PHI maintained by Harbor. We may charge a reasonable fee for copying and mailing. Requests must be submitted in writing to support@harborhealthcare.com.

Right to Amend

You have the right to request an amendment to your PHI if you believe it is incorrect or incomplete. We may deny your request in certain circumstances and will provide a written explanation if we do.

Right to an Accounting of Disclosures

You have the right to request a list of certain disclosures of your PHI made by Harbor in the six years prior to your request. This does not include disclosures made for treatment, payment, or healthcare operations.

Right to Request Restrictions

You have the right to request restrictions on how we use or disclose your PHI for treatment, payment, or healthcare operations. We are not required to agree to your request, except when the disclosure is to a health plan for payment or healthcare operations and the PHI relates to services you paid for in full out of pocket.

Right to Request Confidential Communications

You have the right to request that we communicate with you about your health information in a specific way or at a specific location (for example, by email only or to a specific phone number).

Right to a Copy of This Notice

You have the right to a paper or electronic copy of this Notice at any time.

Breach Notification

In the event of a breach of your unsecured PHI, Harbor will notify you as required by law. Notification will be made without unreasonable delay and no later than 60 days after discovery of the breach.

Our Responsibilities

Harbor is required by law to:

  • Maintain the privacy and security of your PHI
  • Provide you with this Notice of our legal duties and privacy practices
  • Follow the terms of the Notice currently in effect
  • Notify you if a breach occurs that may compromise your PHI

We will not use or disclose your PHI without your authorization except as described in this Notice.

Changes to This Notice

Harbor reserves the right to change this Notice and apply the revised Notice to PHI we already have as well as PHI we receive in the future. The current Notice will always be available on our website.

If you believe your privacy rights have been violated, you may file a complaint with:

  • The U.S. Department of Health and Human Services Office for Civil Rights at www.hhs.gov/ocr

You will not be retaliated against for filing a complaint.
