Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Harbor Healthcare website located at harborhealth-ibp770nq6g.live-website.com/ and all related services, applications, and platforms (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Harbor Healthcare LLC (“Harbor,” “we,” “us,” or “our”) reserves the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on this page with a revised “Last Updated” date. Your continued use of the Service after changes constitutes acceptance.
Eligibility
You must be at least 18 years of age and a resident of the United States to use our Service. By using the Service, you represent and warrant that you meet these requirements.
Our services are not intended for use by individuals under 18 years of age, and we do not knowingly collect information from minors.
Description of Service
Harbor Healthcare is a technology platform that connects patients with independently licensed healthcare providers for medically supervised weight management programs. Harbor does not itself provide medical services, diagnoses, or prescriptions. All clinical decisions are made solely by the independently licensed physicians on our platform.
Our platform facilitates:
- Online health assessments and intake questionnaires
- Virtual consultations with licensed healthcare providers
- Prescription fulfillment through licensed pharmacies
- Medication delivery services
- Ongoing patient support and check-ins
Account Registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to notify us immediately of any unauthorized use of your account. Harbor is not liable for any loss arising from unauthorized use of your account.
Medical Disclaimer
The information provided through the Service is for general informational purposes and does not constitute medical advice. Always consult with a qualified healthcare provider regarding any medical condition or treatment.
Harbor Healthcare does not guarantee that you will be prescribed any specific medication. All prescribing decisions are made at the sole discretion of the treating physician based on your individual health profile, medical history, and clinical assessment.
Results from weight management programs vary by individual. Any testimonials or results shared on our platform represent individual experiences and are not guaranteed outcomes.
Payments and Billing
By subscribing to a paid plan, you authorize Harbor to charge the payment method on file at the applicable rate. Subscription fees are billed in advance on a recurring basis according to your selected plan (monthly, quarterly, or annually).
All fees are non-refundable except as expressly stated in our refund policy or as required by applicable law. Harbor reserves the right to change pricing with 30 days’ advance notice.
If your payment method fails, we may suspend access to the Service until payment is resolved. You are responsible for any fees or charges incurred to collect delinquent amounts.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation:
- Monthly plans: access continues through the end of the current billing period
- Quarterly and annual plans: access continues through the end of the paid period
- No partial refunds are issued for unused portions of a billing period
Cancellation does not affect any prescriptions already issued or medications already shipped.
Prohibited Conduct
You agree not to:
- Provide false, misleading, or inaccurate health information
- Use the Service for any unlawful purpose
- Attempt to obtain prescriptions for anyone other than yourself
- Resell, distribute, or transfer medications obtained through the Service
- Interfere with or disrupt the Service or its infrastructure
- Circumvent any security or access controls
- Use automated systems to access the Service without permission
Intellectual Property
All content on the Service — including text, graphics, logos, images, software, and other materials — is the property of Harbor Healthcare or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written consent.
Privacy
Your use of the Service is also governed by our Privacy Policy and HIPAA Notice, which are incorporated into these Terms by reference. Please review those documents to understand how we collect, use, and protect your information.
Limitation of Liability
To the maximum extent permitted by law, Harbor Healthcare and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or personal injury.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to Harbor in the 12 months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Harbor Healthcare and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
Dispute Resolution
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Greenville, South Carolina. You agree to waive any right to a jury trial or to participate in a class action.
Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
